1Agreement to Terms

By accessing or using the services of Drone Studio Malta ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services or access our website.

These Terms constitute a legally binding agreement between you (the "Client" or "you") and Drone Studio Malta.

2Services

Drone Studio Malta provides professional drone photography and videography services, including but not limited to:

• Aerial photography for real estate, weddings, events, and commercial projects
• Aerial videography and cinematography
• Tourism and promotional content creation
• Property and land surveys
• Custom drone filming projects

3Booking and Payment

3.1 Quotations and Bookings

All quotations provided are valid for 30 days from the date of issue unless otherwise stated. A booking is confirmed only upon receipt of a signed agreement and payment of the deposit.

3.2 Deposits and Payment Terms

• A non-refundable deposit of 50% is required to secure your booking
• The remaining balance is due on or before the scheduled service date
• Payment can be made via bank transfer or other agreed methods
• Late payments may result in cancellation or delay of service delivery

3.3 Pricing

All prices are quoted in Euros (€) and are exclusive of VAT unless otherwise stated. We reserve the right to adjust pricing with reasonable notice.

4Cancellations and Rescheduling

4.1 Client Cancellations

• More than 14 days before service date: 50% refund of deposit
• 7-14 days before service date: 25% refund of deposit
• Less than 7 days before service date: No refund

4.2 Rescheduling

Clients may reschedule once without penalty if notice is given at least 7 days in advance. Additional rescheduling may incur fees.

4.3 Weather and Force Majeure

Drone operations are weather-dependent. If adverse weather conditions make flying unsafe or illegal, we reserve the right to postpone or cancel the service. In such cases, we will work with you to reschedule at no additional cost, or provide a full refund if rescheduling is not possible.

5Service Delivery

5.1 Timelines

Standard delivery timelines are as follows unless otherwise agreed:

• Photo packages: 7-14 working days
• Video packages: 14-21 working days
• Rush delivery may be available for an additional fee

5.2 Delivery Format

Final deliverables will be provided via digital download link or cloud storage. Physical media can be provided upon request for an additional fee.

5.3 Revisions

Packages include a specified number of revision rounds. Additional revisions beyond the agreed scope may incur extra charges.

6Intellectual Property and Usage Rights

6.1 Copyright Ownership

All photographs, videos, and other content created by Drone Studio Malta remain the intellectual property of Drone Studio Malta. Copyright is not transferred to the client unless explicitly agreed in writing.

6.2 Usage License

Upon full payment, clients are granted a non-exclusive, royalty-free license to use the delivered content for the agreed purposes as specified in the service agreement.

6.3 Portfolio and Marketing

We reserve the right to use project work in our portfolio, website, social media, and marketing materials unless the client requests confidentiality in writing.

6.4 Credit and Attribution

Clients are encouraged to credit Drone Studio Malta when using our content publicly. We appreciate tag mentions on social media (@dronestudiomalta).

7Permits, Permissions, and Compliance

7.1 Licensing and Insurance

Drone Studio Malta operates in full compliance with Malta Aviation Authority regulations and holds all necessary licenses and insurance for commercial drone operations.

7.2 Client Responsibilities

Clients are responsible for:

• Obtaining permissions from property owners or event organizers where required
• Informing us of any restricted airspace or no-fly zones at the location
• Ensuring safe access to the filming location
• Notifying attendees/participants if filming will occur at private events

8Liability and Indemnification

8.1 Limitation of Liability

While we take every precaution to operate safely and professionally, Drone Studio Malta is not liable for:

• Damages arising from weather conditions, technical failures, or other circumstances beyond our control
• Indirect, consequential, or incidental damages
• Loss of profit or business opportunities

Our total liability under these Terms shall not exceed the total fees paid by the client for the specific service.

8.2 Insurance Coverage

We maintain comprehensive liability insurance for our drone operations. Details can be provided upon request.

8.3 Client Indemnification

Clients agree to indemnify and hold Drone Studio Malta harmless from any claims arising from the client's use of the delivered content, including copyright infringement claims related to unauthorized use.

9Equipment and Technical Failures

In the unlikely event of equipment failure or data loss, we will make reasonable efforts to reschedule or provide alternative solutions. Our liability is limited to a refund of fees paid. We maintain backup equipment and data storage practices to minimize risks.

10Privacy and Data Protection

We are committed to protecting your privacy. Please review our Privacy Policy for information on how we collect, use, and protect your personal data in compliance with GDPR and Malta data protection laws.

11Content Approval

Clients have 14 days from content delivery to review and request revisions within the agreed scope. After this period, the content is considered approved. Archive access to raw footage is not included unless specifically agreed.

12Confidentiality

We respect client confidentiality. Any proprietary or sensitive information shared during our engagement will be kept confidential unless disclosure is required by law or authorized by the client.

13Third-Party Content

If the client provides materials (logos, music, graphics) for inclusion in the final deliverables, the client warrants that they have the necessary rights and permissions. Drone Studio Malta is not liable for copyright infringement arising from client-provided materials.

14Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of Malta. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Malta.

14.2 Mediation

In the event of a dispute, both parties agree to first attempt to resolve the matter through good-faith negotiation and, if necessary, mediation before pursuing legal action.

15Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time. Active bookings will be honored or refunded if we cannot fulfill them.

16Website Use

16.1 Acceptable Use

You agree not to:

• Use our website for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Distribute malware or engage in harmful activities
• Copy, reproduce, or redistribute our website content without permission

16.2 EU Drone Certification Quiz

Our free EU Drone Certification Quiz is provided for educational purposes only. It is not an official certification and does not replace official training or examinations required by aviation authorities.

17Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18Entire Agreement

These Terms, together with any specific service agreement and our Privacy Policy, constitute the entire agreement between you and Drone Studio Malta regarding the use of our services and supersede all prior agreements and understandings.

19Changes to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a revised "Last updated" date. Your continued use of our services after changes constitutes acceptance of the modified Terms.
